    That part at the end about the NHL saying the PA has engaged in “bad faith bargaining” drew a chuckle out of me.  Yeah, cause throwing money around like candy at the 11th hour prior to a lockout is good faith bargaining

    “The move was done in response to news that the executive board of the NHL Players’ Association voted unanimously Thursday night to give players a vote on whether they should authorize the board with the choice to proceed on a disclaimer of interest.

    If the membership allows the authorization, the NHLPA would have the authority to terminate its right to represent the players could potentially inform the National Hockey League with a declaration that the union no longer represents the players as a bargaining agent. Players could then file their own lawsuits seeking to have the lockout deemed illegal, something that could see them paid triple their lost salary in damages if successful.
    There is no indication on if or when such a vote on the authorization would occur.

    NBA players filed a disclaimer of interest while they were locked out last season, but ended up agreeing to a new CBA 12 days later and the union quickly reformed.”

    Both sides’ lawyers have been working on these scenarios for years now. There have been stories in the papers for over a month about the NHL filing a bad faith bargaining complaint if the players threatened decertification.

    It’s a petition to the court, it can be withdrawn quickly if the two sides put their guns back in their holsters. Same sort of thing happened with NFL and NBA and it never actually went very far because the two sides quickly got back together and hammered out a deal.
